Typically, Mlytics does not host or own the content created by our end users and does not have the authority to remove content from the Internet.

Law Enforcement Information Requests

Require due process

The due process of law must be strictly followed, and judicial review must be applied to all demands made by law enforcement.

While we acknowledge the legitimate needs of law enforcement agencies to investigate criminal and terrorist activities, and while we support them when they adhere to legal protections for doing so, we oppose law enforcement that would mandate or forbid security or encryption technology since it would undermine the security of the goods, systems, or services our customers use, whether they be individuals or businesses.

Provide notice

Unless legally forbidden or in the case of a force majeure event, it is our policy to use our reasonable efforts to inform our customers when a subpoena or other legal procedure requests their account, billing, or other information.

Mlytics will contest any requests from law enforcement that do not follow due process, are too wide in scope, violate local privacy laws, or unreasonably limit our ability to notify our customers of the request.

Respect privacy

The fundamental privacy policy at Mlytics is that any personal information given by our customers should remain personal and private. Both commercial inquiries and law enforcement are subject to the same rules regarding our respect for our customers’ privacy.

Mlytics will not provide customer information to the government unless it is necessary to abide with an order that we judge to be legally binding. Mlytics may utilize its reasonable efforts to contest any orders that it may deem to be unlawful or invalid after consulting with its attorneys and experts and relying on their advice. Mlytics will make a reasonable effort to warn customers of the disclosure of content information, unless doing so is banned or there is a clear indication of criminal behavior in connection with the use of Mlytics goods or services.

Mlytics may retain copies of customers’ information to comply with our legal obligations, pursuant to our data retention policies, or for such reasonable period as is required to address potential disputes.

Requirements from Non-Jurisdictions

Mlytics is registered and operates in the Hong Kong Special Administrative Region of the PRC, where several laws, such as the Personal Data (Privacy) Ordinance, restrict companies from providing certain types of information (such as the content of communications) to any individual or entity outside of Hong Kong. While in some cases it may not be improper to provide basic subscriber information pursuant to non-Hong Kong legal proceedings that follow due process principles, we generally believe that the best way for non-Hong Kong authorities to do so for the time being is to make a request to us through the courts as required by a Mutual Legal Assistance Agreement (MLAT). Mlytics will not provide such information without consulting with its attorneys and experts and being advised that it is a lawful and reasonable request.

How to contact Mlytics

Contact information for law enforcement agencies can be found at abuse+law@mlytics.com. You must provide your badge and case number, as well as other details such as your rank, agency, and unit, to clearly identify you as a law enforcement officer in order to get a response. You must also present the appropriate legal paperwork, such as a subpoena, and identify yourself as such. Falsely posing as a law enforcement officer is illegal and will incur consequences.
